Online Gambling Laws in Canada

Canada does not issue one national online casino licence. The federal Criminal Code sets the boundary, then each province or territory determines the regulated route. Ontario and Alberta admit private operators. The other current casino routes are government-run or publicly owned.

The Criminal Code Creates a Provincial Conduct-and-Manage Model

Canada does not issue one national online casino licence. The Criminal Code permits a provincial government, alone or with another province, to conduct and manage a lottery scheme in accordance with provincial law.

Provincial scheme

A province may conduct and manage a lottery scheme alone or with another province, subject to its own law.

Private operator gate

A private casino enters the regulated system through the provincial structure where play occurs. Registration or a licence from another country does not put a site into a Canadian provincial scheme.

Charitable licences

Separate Criminal Code routes allow qualifying charitable or religious organizations and certain fairs or exhibitions to run licensed lottery schemes. Those event licences are not online casino market licences.

Horse-racing boundary

Pari-mutuel betting on horse racing sits outside the provincial lottery-scheme definition used here and is supervised federally by the Canadian Pari-Mutuel Agency.
